This agreement
Buying from National Motorbike means accepting these terms. They sit alongside our shipping, returns and warranty policies, which form part of the contract.
You must be 18 or older to place an order, and the payment method must be yours or used with the holder’s permission.
Orders and acceptance
Your order is an offer to buy. The contract forms when we email dispatch confirmation, not when you pay. We may decline an order – for a pricing error, a failed fraud check, or stock we cannot fill – and if we do, we refund in full immediately.
Prices are in US dollars, exclude tax until checkout, and may change without notice. We are not bound by an obvious typographical error in a price, but we will always contact you rather than quietly cancel.
Shipping-time disclosure
We commit to dispatching within one business day of a cleared order, and we provide a specific expected arrival date at checkout in line with the FTC Mail, Internet, or Telephone Order Merchandise Rule. If we cannot meet that date we contact you with the option to wait or cancel.
Risk, title and assembly
Risk passes on delivery. Title passes when we have received cleared payment in full.
You are responsible for correct assembly and for following the torque values and maintenance schedule supplied. Many failures we see trace back to a loose stem bolt or an over-torqued crank, and those are not defects. Professional assembly is available at checkout if you would rather not.
Safe and lawful use
Helmets are not included with any product. Wear one.
You are responsible for knowing and following the law where you ride. Regulations for ebikes and particularly for stand-up scooters vary between states and cities, and some trails and paths ban them outright. Our regulations overview is guidance, not legal advice.
- Do not modify a product beyond the settings we ship, particularly firmware limits and battery wiring.
- Do not allow a minor to ride a product rated for adults without supervision.
- Do not carry a passenger on any product not explicitly rated for two riders.
Liability
Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, our total liability for any order is limited to the amount you paid for the product giving rise to the claim, and we are not liable for indirect or consequential losses such as lost earnings, lost use, or the cost of a substitute ride.
Disputes and governing law
Email us first. Almost everything is resolved in a single exchange, and a dispute that reaches arbitration has usually skipped a step that would have fixed it.
If it cannot be resolved, disputes are subject to binding arbitration on an individual basis rather than class proceedings, under the rules of the American Arbitration Association, with the venue in our state of incorporation. Small-claims court remains available to either party.
These terms are governed by the laws of the state of our incorporation, without regard to conflict-of-law rules.
